The Brazilian congress is about to vote on the criminalization of homophobia. Religious parties and churches oppose the law, because priests preaching against homosexuality would face arrest for the crime of homophobia. The proposed law was amended to exempt priests preaching while inside churches. In other words, anyone outside a church can not voice any negative opinion about homosexuality.
Brazil already has anti-discrimination laws favoring gays (in addition to laws against racism, religious discrimination, etc.) Business owners or building managers who disallow gays from French kissing in public face arrests and fines unless they can also prove they have a history of banning heterosexuals from kissing. Hotels must not discriminate against gay couples. This law would further strengthen existing anti-discrimination laws and impose stiff jail sentences.
This attempt at passing laws criminalizing homophobia comes right after the Brazilian Supreme Court, in a rare unanimous vote, decided to take lawmaking into its own hands and declared that gay couples have the same rights as heterosexual couples on all issues, such as inheritance, joint tax declarations, joint health insurance, common law marriage, right to property acquired during cohabitation, etc. Some minor doubts remain if this includes the right for gay couples to adopt children.
No Free Speech or Free Academic Research
Historically, for anti-discrimination laws, even science is not a valid excuse: the book The Bell Curve was banned in Brazil because it violated their anti-racism laws. The US is not much better, as then-President Clinton condemned the book without having read it. But in the US, at least nobody will be arrested and jailed for research on racial differences (they will just be harassed).
It is interesting to note that Brazil’s and Rio’s officials fought to win the title “best gay destination in the world” but are vigorously opposed to “sexual tourism,” meaning heterosexual males looking to hook up with Brazilian women.
The Slippery Slope from Protecting Groups from Violence to Policing Words, Thoughts and Research
Political correctness started as a well-meaning attempt to correct legitimate grievances, like violence against homosexuals or other races (especially blacks) and religions (especially Muslims), as well as gender discrimination (sexual harassment). The next step, still defensible, punishes hate speech meant to directly and immediately incite violence.
So the initial intent was to outlaw “kill blacks,” “exterminate Jews,” and “beat faggots” type speech. But that soon led to stifling thoughts and speech that hurts the sensitive feelings of protected minorities.
It is a serious violation of the freedoms of speech, thought, and research to extend these anti-violence codes to:
- Parents who don’t want their children to become gay;
- Scholarly researchers’ writings about racial differences in IQ and criminality;
- People who warn others to avoid certain parts of town because they are more dangerous (and predominantly black).
Homophobic jokes, racist speech, racist jokes, or anything that mildly upsets a member of a protected minority group can get the offender arrested and jailed. See, for example, Dutch politician Geert Wilders’ prosecution for offending Muslims (who threatened his life and have already killed Theo van Gogh).
Almost everything that can be said is offensive to some protected group, or actually constitutes a crime: our society suffers from overcriminalization.
Public speech and commercial advertising are very difficult nowadays because it is easy to offend some group, be it blacks, Indians, women, the obese, the handicapped, nurses, or any group in existence. Maybe with the exception of white males who can be bashed infinitely because they don’t belong to any disadvantaged minority group.

Churches, going all the way to the top, have, to their disgrace, surrendered to liberalism on key things like immigration and aspects of feminism. Maybe they should quit bitching about risking arrest and instead re-read their histories of various martyrs and preach according to their principles, even if it gets them arrested.
Kinda funny, I studied for 7 months in Brazil (Bahia and Sampa) and for all of their international boasting of being a racially harmonious society it still looked pretty fucking racist to me. Way worse than the part of the Midwest where I’m from.
I’mma give Brazil some advice from up north: Your country has one of the highest crime rates in the entire world – maybe you might want to do something about the fact that gangsters with assault rifles control large portions of your major cities instead of embracing every stupid, egalitarian left-wing cause out there. Barring that, you might work on your byzantine tax system (CPF na nota?) and try to make your economy better rather than worrying about the feelings of a tiny portion of your population.
It’s not about equality.
It never was. I don’t believe in coincidence in politics and human affairs.

It ‘s ironic. The “minority” groups abuse these freedoms with full knowledge that if they should win, the freedom will disappear. There’s only so much room at the trough, and not everybody is going to get their bribe.

Homophobia is a loaded, inaccurate word to begin with. I don’t know anyone who FEARS fags, but I know plenty of people who HATE them or are DISGUSTED by them.
Americans only hear (via our corrupt Liberal MainStream Media) that Brazil is a capitalist paradise that grows its own gasoline/ethanol. But it appears our countries have much in common – with our Bread & Circuses.

The only ones who stood up against it was the small group know as “TFP” (Tradition, Family and Property), a couple churches, and a few skinheads.
For most people, this law criminalizing “homophobia” (whatever the hell it is) is of self-evident importance. Not only the local brand of SWPLness.
So this is the most fucked up aspect of all this: its a coercive and draconian law that is being welcome by the ones who will be subjected to it. The very people who also make gay jokes often, but praise the symbolic value of this law, ignoring the fact that it will bite you in the ass eventually.
Bear in mind that Brazil dont have a tradition of democracy and civil engagement. The average brazilian is acostumate to being irrelevant to the destiny of the country, and is cynical about democracy. And most important, this citzen have a mendicant relationship with the government: hence why there is no right wing in Brazil (really there isnt); and why paternalistic politicians are celebrated.

I have to disagree with Enigmatico (hey dude, how ya doing?) in a couple things. Brazil is not a hell hole.
Specially from an MRA point of view: shared custody is the standard custody arrangement; you can get rid of fraudulent paternity; prostitution is legal; and a couple other MRA cause celebre I cant recall.

Well i have to agree with you that Brazil isnt a hell hole from the MRA point of view. Because our law works to slowly and with money and a good lawyer you can be safe whatever the issue is. (maybe this will change at Dilma government…)

Its indeed strange to talk to you in another language particulary because we talk often – in portuguese.
Its true, most brazilians dont have high culture. Dont fool yourself, americans complain all the time about the “proles and the rednecks”. Every country has simple people and Brazil is not different in this matter.
Now as for manners, most brazilians dont have a firm grasp of etiquette, and sometimes try to compensate for it in a gauche way.
Anyway, we are missing the point.
The worst thing about Brazil, is the willingness to imitate the poor exemples of developed countries, because of an admiration for theyr wealth.
No matter how much Sweden is an Orwellian distopy, for an exemple, most brazilians think that if we make Brazil the same politically correct hell, we will somehow become developed (and in brazilian portuguese “developed” equals rich, and that is all).
So if the gringos are fretting about gay marriage and race, etc, then brazilian middle class assumes we should too.
They dont realize that all it will lead to is a lot of bothersome political correctness in a still poor country.
